Ein Mail des Systemadmins:
Es fängt wieder an.
Von scientology.org aus war wieder täglich Besuch auf den Seiten,
es war wohl ein grober Fehler das Blocking von Scientology nicht
wie schon vor Monaten empfohlen einzurichten...
Das habe ich jetzt mal in der Server-Konfiguration gesetzt.
Bitte um baldmögliche Stellungnahme über das weitere Vorgehen.
Falls das Copyright nicht bei Scientology/RTC liegt empfehle
ich eine Anzeige wegen übler Nachrede o.ä., ansonsten müssten
die beanstandeten Seiten auf einen anderen Server verlegt werden,
idealerweise in Deutschland, Skandinavien oder Russland.
Ein paar Tage spaeter hoerte ich, dass mein Provider eine Mail erhalten hatte. Der Systemverantwortliche (man bin ich froh, dass da ein solcher Profi arbeitet) leitete sie mir weiter:

Im the owner of the Website charlies-playhouse.ch wich is hosted in
Switzerland. Perhaps you dont know its a own country and has its own laws.
And, its Europe not the USA.
Your threatening letter might be useful in the States but not here in
Switzerland. It just looks like typical american arrogance to me.
I have my reasons to have this Website. One of it is that I've wasted plenty
of money in this so called Church. I was Staffmember.
Your letter are making me really thinking go to court in Switzerland to get
all of my money back and clear this copyright thing. This would be not very
good for the downstanding Class 4 Org in Zurich. AND THIS WILL HAPPEN IF YOU
DONT STOP YOUR HASSELS ON EMAIL. In fact it would cost the so called Church
of Scientology much less money and effort if you leave me and my site.
Its not shure to me that you are really the person that you say you are.
Everybody can fake an email. So if you have to say something do it with an
letter. And on this letter the colors of RTC. So that there is a chance to
see that you really telling the truth about you and your client.
If your really willing to go to court here in Switzerland so do it. Im
ready. We have other copyright laws here in Switzerland and I suggest you to
study these.
And, write to me and not to my provider. Only cowards used to do this.

Charlies-Playhouse ein paar Stunden offline
Jahreswechsel 1998/1999
Hierzu nähere Informationen:
Ich hatte meine Webseiten (3 verschiedene Domains) bei Pair Networks in Amerika. In der Nacht von Montag auf Dienstag bemerkte ich, dass kein Zugriff übers WWW zu allen meinen Domains möglich war.
über Telnet kam ich aber in mein Verzeichnis rein und bemerkte, dass jemand die Rechte verändert hatte (drwx --- --- mit mir als Eigentümer). Ich dachte zürst an einen Hack, doch alle Dateien waren in Ordnung und sonst konnte ich auch nichts auffälliges feststellen. So hab ich denn meine Domains wieder auf World-Readable gestellt und das Passwort geändert. Zudem schickte ich ein Mail mit der Bitte um Aufklärung an meinen Provider in Zürich. Kurz darauf kam Antwort und auch der verantwortliche Mitarbeiter wusste nicht was geschehen sein könnte.
Heute Morgen (30.12.1998) bemerkte ich, dass meine Domains wieder unzugänglich gemacht worden waren und etwa zur gleichen Zeit erhielt ich eine Message vom Provider in Zürich mit einer weitergeleiteten Mail von Pair Networks. Scientology hätte mit Prozessen gedroht und Pair Networks meint, dass sie gegen die Scientologyanwälte nicht an kommen würde und wollte meine Domains (wovon sich nur eine mit Scientology
beschäftigt) nicht mehr auf ihrem Server haben..
Natürlich versuchte ich sofort in meine Verzeichnisse hineinzukommen, doch Root (Pair) hatte den Eigentümer geändert, dass mir der Zugriff ganz verwehrt wurde.
Heute Nachmittag telefonierte ich mit dem Verantwortlichen von Virtual Media in Zürich um die Seiten schnellstens wieder zugänglich zu machen. Herr S. richtete mir innert kürzester Zeit ein neüs Konto auf einem Server in Zürich bei Datacom ein. Während ich dies schreibe ist der Upload schon im Gange. Ich möchte mich für diesen vorbildlichen Service von Virtual Media hier öffentlich bedanken. (Wenn ihr mal einen schnellen Top-Provider braucht .... http://www.virtual.ch ..ich kanns nur empfehlen :)
Pair Networks wird mit diesem rabiaten Vorgehen Problebe haben, da nun auch bei Scientology bekannt ist, dass Pair beugsam ist. Von den rund 40'000 Domains werden sicherlich noch einige entfernt.

materials are confidential, unpublished, copyrighted works. RTC's works include, among others, the individual works comprising levels known as "NOTs" "OT III and the "Class VIII Assists Lecture". These works are registered with the United States Copyright Office under registration numbers: TXu 257 326 and 257 527; TXu 290 496; and TXu 593- 514.
I have been informed that you have placed certain of these copyrighted works on your homepage without the authorization of my client. These works can be found under the following URLs:

Just this week, a jury convened in the United States District Court in San Jose, California and assessed damages in the amount of $75,000 against him for placing "NOTs 34" on the Internet. Mr. Henson is also permanently enjoined against further infringements. Additionally, a United States District Court in the state of Virginia granted judgment for damages, costs, and a permanent injunction in favor of my client related to copyright infringement of similar works.
The Regional Court of the Hague has recognized that similar materials are copyrighted, and the defendants in the Dutch case removed their postings of the copyrighted materials in that case. Moreover, in Sweden, RTC sued an individual for infringement of similar materials which he had placed upon the Internet and in that case, the court issued an injunction prohibiting him from engaging in such illegal activities.
Please confirm that you have removed the copyrighted material as requested above.

In accordance with our service agreement and our contract with UUnet, we have disabled access to the two URLs specified in the attached complaint from the infamous Helena Kobrin.
I suspect that there is a broader range of material that they intend to have removed, although my German is too rusty to be certain. If you could please move the material in question to a different host or take it offline, we would very much appreciate it. I'm sorry, but we do not want to pursue trouble.

Auf diesen Site habe ich u.a. folgende Statements gefunden:

Die Disskussion um rassistische Homepages wurde in letzter Zeit mit einiger vehemenz auch in der Oeffentlichkeit gefuehrt, die Mitverantwortung der Provider herausgestrichen.
Dies ist auch der Grund weshalb ich an Sie gelange und Sie hoeflich ersuche Herrn Maijs Site zu sperren.
In Ihren Allgemeinen Geschaeftsbedingungen haben Sie sich herausbedungen den Zugriff fuer ein Angebot zu sperren, wenn Dritte in ihrer Ehre verletzt werden koennten, Personen oder Personengruppen mit radikalen oder extremistischen Inhalten angegriffen, beleidigt oder verunglimpft werden oder wenn Inhalte nach dem allgemeinen Rechtsempfinden gegen geltendes Recht der Schweizerischen Eidgenossenschaft verstossen koennten.
Die Schweiz hat 1995 den Antirassismus-Strafartikel eingefuehrt, der gegen Hasspropaganda aus rassistischen, aber auch religioesen Gruenden eingesetzt werden kann.
Sientology ist weltweit als Religion anerkannt worden, ebenfalls in der Schweiz durch Bundesgerichtsurteile und andere Behoerden.
Die Homepage von Karl Maij verstoesst z.B. mit den oben angegebenen Publikationen gegen diesen Artikel, der auch die Foerderung und Unterstuetzung von Propaganda unter Strafe stellt.
Wir ersuchen Sie daher, das Angebot von Herrn Maij zu sperren und uns eine kurze Mitteilung darueber zukommen zu lassen, dass sie diese Massnahme ergriffen haben.
Gegen Herrn Maij werden separat rechtliche Schritte geprueft.
