The Art of the Deal: Jared Kushner's Hacked Phone

Dutch spies flipping a Russian agent, giving them access to Jared Kushner's phone that Russian spies had hacked to reveal payments from Middle East leaders sounds like the plot of a Bond movie. Hey, remember how Hillary Clinton had some soup recipes on a private email server? Vanity Fair / unpaywalled.
Mohamed bin Zayed (MBZ) of the United Arab Emirates and Mohammed bin Salman (MBS) of Saudi Arabia together paid at least 2 billion dollars to Jared Kushner, laundering money to an Israeli bank account through a bank in Azerbaijan. None of this was disclosed to the public as required by law. Also, we know about it because Russian hackers could see and take screenshots of everything on Jared Kushner's iPhone. The money could have been used to pay off a billion-dollar loan coming due on the Kushner's trophy property, their Manhattan office building at 666 Fifth Avenue. As far as I can tell, this is a separate, secret pool of money not related to the 2 billion dollars the Saudi Arabian government openly invested in Affinity Partners, Kushner's investment firm, from which he drew a salary of several hundred million dollars. this paragraph from deep in the article is a good summary:

"Kushner's apparent betrayal of the public trust, however, went further than his failure to disclose the secret Alpha account in the UAE or the Beta account in Israel. By giving him access to roughly $2 billion, regardless of how the money was used, MBZ and MBS were paying for his influence within the US government. Any efforts he made to shape US policy that came from a foreign government that had provided him with money would make him an agent of a foreign power. US law requires citizens who lobby on behalf of a foreign power to declare themselves and the country they are working on behalf of to the Justice Department."

This grift is much the same across the adminstration (which Kushner isn't technically part of!), but Jared is doing it at a truly grand scale.

Related: CREW sues to block Jared Kushner from acting as Trump envoy. From the complaint (CREW v Kushner et al):

69. Kushner worked in the White House during President Trump's first term. In conjunction with that government service, he filed financial disclosures pursuant to the Ethics Act—although, as with his current position, he did not draw a salary. His wife, Ivanka Trump, also worked in the White House and filed financial disclosures. Those financial disclosures reveal that Kushner and Ivanka Trump earned between $172 million and $640 million in non-governmental income while working in the White House.72

70. After the first Trump administration came to an end in 2021, Kushner launched an investment firm, A Fin Management LLC (known as "Affinity Partners" or "Affinity").

71. Within six months, Kushner secured a $2 billion investment from the Public Investment Fund ("PIF"), Saudi Arabia's sovereign wealth fund led by Saudi Crown Prince Mohammad bin Salman. As reported by the New York Times, this investment was made over the objections of a panel of PIF advisors regarding "'the inexperience of the Affinity Fund management'; the possibility that the kingdom would be responsible for 'the bulk of the investment and risk'; due diligence on the fledgling firm's operations that found them 'unsatisfactory in all aspects'; a proposed asset management fee that 'seems excessive'; and 'public relations risks' from Mr. Kushner's prior role as a senior adviser to his father-in-law, former President Donald J. Trump."73 According to this reporting, a July 2021 letter from PIF staff stated that "'[t]his investment aims to form a strategic relationship with the Affinity Partners Fund and its founder, Jared Kushner.'"74

The (relatively recent, and unsupported by the Constitution) reliance on "standing" has thwarted a ton of public interest legal action. I kind of love CREW's position here:

* we use government records, including public financial disclosures
* Kushner is breaking the law by not filing the legally required public financial disclosures
* therefore, we have standing to petition for relief:

WHEREFORE, Plaintiff respectfully requests that this Court:
(1) Declare that Kushner is unlawfully serving as an officer of the United States, in violation of the Appointments Clause of the Constitution;
(2) Permanently enjoin Kushner from exercising the powers of an officer of the United States unless and until he is appointed and confirmed in accordance with the Appointments Clause;
(3) Permanently enjoin Witkoff, Wiles, Rubio, Hegseth, OSPM, EOP, WHO, the State Department, and the Department of Defense from facilitating or supporting Kushner exercising the powers of an officer of the United States;
(4) Issue permanent relief, including but not limited to injunctive and/or mandamus relief, directing Kushner to file all financial disclosures required by the Ethics Act for the time that he unconstitutionally served as an officer of the United States in violation of the Appointments Clause;

I learn so much from reading court filings and rulings.

It is shocking that Russia AND the EU could fully see every single thing Jared Kushner was doing on his iPhone, including all the foreign bank accounts he had, and that he received billions of dollars into accounts he had full control over from foreign governments, and that none of this was reported by the mainstream US press as treason even after Kushner got us into a war that destroyed or degraded all our bases all across the Middle East.

Intriguing traces of late-stage revision in this sentence:

Kushner was overseen only by his father-in-law, who, according to four senior Trump administration officials—two national security advisors, a White House chief of staff, and a former CIA director—were unaware of any presidential authorization for Kushner to access a foreign government bank account.

This might just be careless editing. But I wonder if the original version contained a stronger allegation about Trump's involvement which was then rewritten by Vanity Fair's lawyers.

Am I missing something or does this sentence's grammar just not line up. A weird editing artifact?

Either the "were" I bolded should be a "was" (in which case it parses, but barely makes sense as reportage, citing four officials' belief that Kushner's father-in-law was unaware of presidential authorization for Kushner to etc?) or...two sentences got merged and whatever this one was supposed to be saying about Kushner's father-in-law disappeared into the ether?

Or I guess I could (quickly, clumsily) fix it up as:
Kushner was overseen only by his father-in-law, [and] four senior Trump administration officials—two national security advisors, a White House chief of staff, and a former CIA director—[each say they] were unaware of any presidential authorization for Kushner to access a foreign government bank account.

I'd bet that was the intention. I wonder what went wrong here.

I'm totally confused by this article. Like, I could believe that Kushner is the kind of guy to take money from Mohammed Bone Saw and so forth. The thing I don't get is: (a) The Dutch spies find out about Alpha but not Beta? Or the article is poorly written enough to not explain where information about Beta is coming from. (b) The British somehow let the Dutch take this Russian spy -- why? Like, he's either flying into Schipol or Heathrow. If Schipol, they don't need UK permission. If Heathrow, why don't the British just take him? What is definitely not happening is the Dutch arresting someone on UK soil. That's just not a thing. Compare what the US had to do to get Xu Yanjun in Belgium -- the Belgian police did the arrest (c) The Dutch then take this information and sit on it for the entire Biden administration before leaking it to a random journalist. Alternately, they tell the Biden administration and the Biden administration does nothing. That's more plausible, except why not leak it during the election? Or they do leak it during the election, but to a guy who thinks he needs it for his book and sits on it for two solid years? And nobody in the Biden administration leaks it?

Anyway, this article is sketchy as hell.

Before the behemoth building at 666 5th Avenue, was the "Petit Chateau, Jr.," a mansion designed and built by Stanford White for William Kissam Vanderbilt, Jr., in 1905. (Petit Chateau "Sr." was next door). Vanderbilt separated from his wife Virginia, who continued to live at 666 Fifth Avenue until moving out shortly before the building was torn down in 1926. She relocated to 660 Park Avenue which she quickly renumbered, 666.
I researched this because the mansion was featured in my historical mystery, Floor 24.

There needs to be a massive clean-up after TFG leaves office, one that involves thorough investigations of the entire administration and the Trump family, and appropriate sentencing for everyone who is found guilty.

The list of violations of fundamental human rights also needs addressing, but I really, really doubt any of this - whether rights violations or corruption - is going to be dealt with. There will be no truth and reconciliation, no apology, no reparations, from any US administration. If there is another US administration.

Perhaps generations down the road. Perhaps.

You and Marcy Wheeler

And even assuming the Dutch did learn of some of this, the Dutch didn't learn all aspects of it, leaving unexplained what provenance there is for other parts of the story.
A shallow audit, as the Dutch tried while monitoring Kushner's iPhone, revealed nothing more than what appeared to be an Azerbaijani government–linked bank account that sent hundreds of millions of dollars to an account in Dubai. But there was another aspect of the Alpha account that the Dutch couldn't see or understand, one that helped reveal the secret purpose of the money. Kushner did not own the bank account at First Abu Dhabi Bank. He was a signatory for an account managed and owned by an Emirati charity.

So on the key allegation — that Jared had access to two secret bank accounts via which he was conducting his own covert operations — is really tenuous.

Plus, Cole seems to have taken denials this operation was approved as confirmation it existed.

One of the many things worrying me about this wildly flailing kleptocacy is the strong feeling that theyse vampire ghouls are doing this basically all out in the open. Meaning they believe (know?) they are never going to pay consequences. Now why would they believe that? 1) They believe (know?) that the Schumer Jeffries opposition is basically too obsequious to do anything but fold, and will do nothing to deter them, let alone make the pay consequences. Awful yes, shocking I know, but not the complete death-knell of our semi-democracy; or 2) they are locked and loaded, literally, and will not give up power under any circumstances (wholesale military leadership decapitation and replacement by magas; DOJ contesting every single democratic victory in the upcoming mid-terms; troops seizing voting equipment, ballots anything showing the democratic victory; the megalomaniac child rapist declaring martial law; Johnson refusing to seat the new congress and the maga court saying "a-ok" and on and on). That would be the death-knell of our semi-democracy.

But it is very good to see definite documentation and proof of a type that is hard to deny.

This isn't definite documentation and proof. This is a single reporter taking word of mouth from two sources he trusts. It's important to keep that in mind.

As telepsism linked above, there are some like Marcy Wheeler who are skeptical of the story--not because Kushner isn't very obviously corrupt in a lot of ways, but because there's good reason to be cautious with reporting like this when it first lands.

I've found Marcy Wheeler to be a highly astute observer of the Trump ecosystem. She does an excellent job at parsing through publicly available documentation to align it with anonymous sourcing like this. Her blogging throughout Russiagate was superb in this regard--providing the nuance that headline reports were incapable of and throwing cold water on the conspiracists like Louise Mensch on the Twitter-verse. So when she says "OK, read this carefully, because there are a lot of questions this raises," it's good to listen.

I don't know anything about the author, Matthew Cole. He seems to have a strong resume, but I know nothing of his track record, and this is apparently a book excerpt. That always gives me pause.

It's entirely possible this is disinformation that wound its way through to Cole in ways similar to the Steele dossier: a splash of truth combined with outlandish and unprovable (or disprovable) information designed to just throw shit into the media ecosystem with the idea of tainting the entire discourse.

During the Serene Republic days, Venice would investigate all family members of the last Doge when the new one came into power. Not because anything suspicious came up, the investigation was automatic. Why Is Tech Billionaire Marc Andreessen So Mad? - "His grievances don't always match reality."
In May 2023, a16z said it committed $500 million to its new focus on what it calls American Dynamism, which involves investments in homegrown companies in defense tech and other industries of strategic importance, such as Anduril Industries Inc. and SpaceX. Also in this portfolio is Flock Safety, which makes surveillance technology for police departments and commercial organizations. CEO Garrett Langley says no VCs wanted to get near Flock because of its third-rail mission, glossing over the fact that Y Combinator, Peter Thiel's Founders Fund and five other institutional investors had backed the startup before a16z.
