The hearings will determine if the defendants can get a fair trial. Lawyers for Khalid Sheikh Mohammed and four others will continue arguing that the case should be thrown out. They contend that U.S. government agents gained confessions from the suspects through illegal torture. Government prosecutors will argue that the methods used to obtain confessions were proper. They will also try to preserve the secrecy of the so-called "black sites" where the suspects were taken when they were arrested. Judges will also consider a motion whether to call top government officials to testify, including former U.S. President George W. Bush.
