Emulation is not illegal. Neither is ripping or downloading ROMs. Redistributing them might be, but it's all a huge gray area. Companies, while quick to point out it's all illegal, actually, are loathe to bring down legal action for fear of finding out the actual legality of the situation and ending up codifying it in a court of law.This includes the weird-ass motte and bailey defence of "well what about the console BIOS, you didn't pay to get that software, and without it the emulator is useless, so checkmate". Sony tried in the past to use this argument in order to block sales of a for-profit emulator, Bleem! It didn't work out for them and they lost the court case, twice. That was 23 years ago. Since then a fair fewer cases were brought, and most against entities that can't realistically fight back and whose best bet is to just close up shop.The big takeaway is that it's all a gray area by design.

lawyers always react to the first case of ace attorney, with some good points. but I wanna see a lawyer react to that one case in Dual Destinies where the defendant is an orca, and the prosecutor is an active death row inmate with a feral hawk as an assistant council, and they cross-examine the orca, and there's a penguin in the courtroom at one point

Turns out Calckey has been claiming authorship of code they didn't write. Which I'm pretty sure is a violation of the AGPL.How could this happen? Well, in lieu of adding licence attribution comments at the top of every file in a FOSS project, some projects use git's co-authored-by field to keep the project files cleaner, to not muck about with keeping CONTRIBUTORS.md up to date (a laborious and error-prone process), and to leverage the bookkeeping that git automatically provides.The Calckey project has repeatedly (mis)used git in a way that removes or mangles attribution history, affecting multiple contributors of the codebases they fork and upstream from. (I have attached several examples below) This makes it so the features they merge in are labeled as authored by members of the Calckey project, instead of the original authors, in a way that makes it impossible to know who the original author was.Recently, Helene, an affected contributor, tried to bring this up and get it corrected in this issue. They flippantly demanded "proof" in an unreasonable timeframe, and when confronted with proof, then doubled down and claimed it's not an issue.Now, obviously, I'm not a lawyer, I just think this behaviour is incredibly scummy, and needs to be pointed out. Doubly so from a project that markets itself as a professional endeavour. After all, this is not little Timmy's side-project, but part of a paid service they draw income from.They think this behaviour is perfectly fine. Some guy told them that they can delete contributor history because it's not a part of the licencing, and that's good enough for them. By that logic the CONTRIBUTORS.md file can be deleted too, after all, it's not part of the licence either.Examples of this behaviour (there are dozens more):this commit is shown as made by Calc, but is actually by Johannthis one is copy pasted from misskey, with the authorship similarly outright removed (it's probably by Syuilo but figuring that out would require digging through the other codebase, the existence and location of which is not even clear from the commit)this one comes from Toast, with the Co-Authored-By being mangled and not parsable

@panos@calckey.social Call me thick-headed but if you remove someone's co-authored-by tag and add an authored-by tag that is a different person, there's not much else for me to conclude. I can sympathise that this was most likely not the intention. But then again I don't have mind reading powers, I don't know what the intentions were.As for good faith, you can't say "oh, we thought this was a troll all along" and then insist you were prepared to engage in good faith. A concerned contributor was given a weird ultimatum and then when they explained themselves were told repeatedly that it's not an issue because of how non-lawyers interpreted this issue. Is that good faith?
