       Regarding the three Title VII employment cases argued before the U.S. Supreme Court on October 8:There were THREE cases before the Supreme Court. The issues in them are different. Two are brought by gay men and are about whether firing based on sexual orientation is firing “because of sex.” The correct result in those two cases should be a no-brainer for any progressive person: of course being gay or lesbian is about one’s sex, so being fired on the basis of sexual orientation is clearly “because of sex.” You are being fired because your sexual orientation is for those of your same sex.The Harris/Stephens case is about a completely different issue. The plaintiff in that case is essentially suing to demand that his employer recognize him as a woman and call him a woman and require everyone else in the workplace to call him a woman. He did not challenge his employer’s dress code or dress codes in general — rather, he demanded that he be allowed to follow the dress code for women and be referred to and “treated as” a woman. He claims he is a woman because he identifies as a woman. Even though he is a biological male. For the Supreme Court to rule in his favor, by necessity they have to redefine “sex” in Title VII to mean gender identity rather than biological sex. This is why this case is so important. It would remove sex based protections from TItle VII.Anyone who claims that the Harris/Stephens case is just about one man being fired is either confused or lying. It’s about the definition of “sex” in Title VII. The ACLU was very strategic in the case they chose and what they are claiming it’s “about,” but because of the way the legal issues were presented, there is no way for the Supreme Court to rule for the fired man without redefining “sex” to mean “gender identity.”

       The strategy in the Harris v. EEOC transgenderism case was very deliberately NOT to challenge the legality of sex-based dress codes. So the case would do nothing to help gender non-conforming people be free from dress codes.First of all, Price Waterhouse has not been applied to hold that sex-specific dress codes violate Title VII. The Ninth Circuit walked back Price Waterhouse by holding in 2006 in Jespersen that sex-specific dress codes don't violate Title VII unless they put a much heavier burden on one sex than the other to comply with a list of grooming requirements. The Supreme Court has allowed that decision to stand since 2006. Second, Stephens in the Harris case did not argue that dress codes violate Title VII, so that issue is not before the court. (He wanted to follow the women's dress code; he didn't argue that the dress code violated Title VII). Nor did he argue that he is a man who was gender non-conforming by "looking like a woman," which would have been a claim under Price Waterhouse's prohibition of sex stereotypes. Rather, he literally argued that he IS a woman because he "identifies as a woman" and that the employer violated Title VII by refusing to call him a woman, "treat" him "like a woman," and demand that other employees and customers call him a woman and "treat" him "like a woman." His argument is that recognizing someone's biological sex and refusing to pretend that they are the opposite sex is sex discrimination under Title VII. The only way the Supreme Court could rule for Stephens on the claim he actually made would be to redefine the word "sex" in Title VII to mean "gender identity" (i.e. the sex you "identify as") and to rule that if you refuse to treat someone according to their stated "gender identity," you are discriminating against them "because of sex" (the test under Title VII).

       "[The] trans movement, separate to the gay and lesbian movement, has built itself an entire infrastructure over the past ten years. ‘LGB’ has morphed into ‘LGBTQI+’. One Canadian school district managed to morph the ‘LGB’ acronym into ‘LGBTQITTIPASFDASFAARP’ (or something similar) which led to a round of healthy internet mockery. The transgender movement is not marginalized voices finally being heard; it is a case of large amounts of money being heard. According to Funders for LGBTQ Issues (FFLI), funding specifically earmarked for transgender causes began rapidly increasing in 2012; by 2016 it outstripped the funding for gay, lesbian and bisexual combined (a total of $13.2m), at a cool $22 million total in funding, specifically earmarked for transgender causes. That’s over 10% of the total LGBTQI funding tracked by Funders, which is $202m total.That the money comes from a wide range of philanthropists: while names such as George Soros’ Open Society Foundation, Arcus (run by gay Stryker Corp heir Jon Stryker) and Tides come as little surprise to anyone following money on the center left of politics. But other names stand out: Jennifer Pritzker, (formerly Col. James Pritzker) who came out as a trans woman in 2013, through their Tawani Foundation, who outside of transgender causes, is a far-right Republican and supported Trump-supporting candidates in the 2016 election. This has come as specifically earmarked funding for gays and lesbians has declined in the same period — foundation and philanthropic funding for lesbians was a not-so-cool $4 million in 2016, despite being a far larger population than transgender people. Overall, LGBTQI+ Funders reports over $202m in total philanthropic funding for LGBTQI+ organizations in 2016, and much of this funding is simply a donation to organizations who campaign for a broad variety of issues. 39% of funding goes towards Advocacy — given the huge focus of LGBTQI+ organizations on transgender issues, they are likely getting a more disproportionate slice of the pie than the figures show.        When I was growing up in the USA in the 70s and 80s, the grownups and kids I knew never talked about gender. (When I say “gender,” I mean stereotyped social roles).Kids all dressed pretty much the same and did a lot of the same activities. Girls might be more likely to play with dolls than boys, but other than that no one ever policed or discussed what we wore or liked to do. Girls also didn’t wear makeup much and weren’t constantly sexualized.I literally saw things change before my eyes and become pink-Ified for girls when Disney started pushing all the princess shit in the 90s. I could literally watch the social shift happen.
