@interfluidity A very good question (derogatory).I think this administration’s [sic] wildly expansive reading of “foreign policy” is long overdue for a deeper interrogation.The legislative intent (especially in the INA clauses they’re relying on) was specifically about making diplomatic relations more difficult and/or directly impacting policies and treaties outside the country, and *not* “in some way touches anything foreign”. Which passports definitionally do.

@dpp @interfluidity Agreed. Hawai’i v. Wilson was a shot *inches* off the bow of the Roberts Court — and that was *last* year, before this lawless rampage. (Granted, Recktenwald is no conservative. But he’s not the only one pushing back. )

@dpp @interfluidity The real sign will likely be the NCLA suit on the tariffs. Firmly right-wing, taking Roberts’s “major questions doctrine” fabulism at face value. By its own terms it commands overturning the universal tariffs; if they do in fact apply the “only applicable to Democratic Presidents” clause they will have announced they are no longer even pretending.

@interfluidity It’s especially jarring against the backdrop of obsessive legal compliance endemic in the (actual) civil service. A tiny example: It seems impossible to believe federal contractors wouldn’t email the contractors directly, so as to avoid even the appearance of improperly directing the use of appropriated funds.
