The state court judge rejected Vizio's arguments. The decision says SFC's claim is not preempted by copyright law and that consumers like us have standing to enforce the #GPL as third-party beneficiaries to the GPL! Now on to our Summary Adjudication movement...https://sfconservancy.org/news/2023/dec/11/response-to-bigtech-arguments-copyright-office/

As you may have seen at @fosdem this past weekend, we announced a new community tool for fixing GPL compliance issues: Use The Source. We encourage people to upload, share, and comment on source code candidates for products which run copylefted software so we can find out which products (and companies) give us the required software right to repair, and which ones still need work. Join us and help improve things for everyone!https://sfconservancy.org/news/2024/feb/03/use-the-source-launched/

Relatedly, as an effort to help corporate teams better respond to copyleft compliance, we are recommending that companies create a "Copyleft Compliance Incident Response Team" (CCIRT). An area that often falls in between the cracks of engineering, support, and legal teams; a dedicated team responsible for handling the obligations of copyleft compliance will help both end users contact and get the source they are entitled to, and help companies be streamlined in handling licensing and distribution of their copyleft products. You can read more about our suggestions here:https://sfconservancy.org/blog/2024/feb/03/ccirt-security-and-software-right-to-repair/

"Copyleft is quixotic, copyleft is rebellion.""The history of copyleft as an activist strategy can only be understood through the lens of 20 years of cooption of FOSS into mainstream tech."

"Copyleft licenses are primarily about your rights, as a downstream user who wants to modify/recompile/reinstall your software, not about the “rights” of copyright holder. You are a third-party beneficiary of the licensing terms."

Bradley and @karen published their thoughts about the TikTok ban yesterday:"Users (and our government) should instead insist that, to operate in the USA, that ByteDance respect the software rights and freedoms of their users by releasing both the server and App components of the software under a “free and open source” (FOSS) license.https://sfconservancy.org/blog/2025/jan/18/usa-should-require-bytedance-to-open-source-tiktok/

The historic Software Freedom Conservancy v. Vizio, Inc. case continues in Superior Court in California!SFC announced that we recently filed an updated Motion for Summary Adjudication (similar to a Motion for Partial Summary Judgement in USA federal courts): https://sfconservancy.org/news/2025/jul/10/sfc-updates-motion-for-summary-adjudication-vizio/ The motion asks the judge to summarily rule that SFC has a right as a third-party beneficiary underthe popular copyleft licenses — GPLv2 & LGPLv2.1.A direct link to the filing: https://sfconservancy.org/docs/2025-05-23_SFC-vs-Vizio_second-SFC-Motion-for-Summary-Adjudication.pdf Also, please do reply to this thread for discussion all day today and tomorrow (2025-07-1{0,1}) with our Policy Fellow @bkuhn about the filing and more information about the Vizio case!Keep in mind the trial is *this September* starting on 2025-09-22 in Santa Ana, CA & it's open to the public!

Big news: a recent copyleft lawsuit we funded and supported has concluded with a very positive result for user rights! The suit, brought by a device owner in Germany, resolved with the purchaser receiving the right to repair, modify, and reinstall LGPLed software on their devices. Check out the details at https://sfconservancy.org/news/2025/jan/09/avm-copyleft-lawsuit-resolved-with-install/
