       When the prosecution rests in the Manhattan case, I plan to read the transcripts so far looking for evidence that supports the elements of particular crimes.This is my thing: Reading trial transcripts. My job was reading trial transcripts looking for appealable errors.Shall I tell you my favorite moment in a transcript?The defendant (yes, my client) walked in to court with baggy pants. The judge (a woman) was offended and angry. She thought the defendant was disrespecting her.1/

       She was so angry that the prosecutor felt bad for the young man and came to his defense. (It's hard to read emotion in a transcript, but she was obviously furious for the prosecutor to come to his defense.)First the defense lawyer tried to explain that it was (unfortunately) the current fashion. The prosecutor confirmed that it is a fashion.The judge said, "Well. It's a fashion felony." (Reading it, I could allmost 'hear' her  sputtering.)I adopted the phrase "fashion felony."2/

       Before I analyze the jury instructions, which concern evidence, I have a funny story.My stepson was 12 when I was in law school. I introduced him to my evidence professor. Later stepson said, "Did you notice he gave you a funny look when you said he teaches evidence?"Me: "No. Why did he do that?"Kid: "You said he teaches evidence. You can't teach evidence because there is nothing to teach! Either it is evidence or it isn't."All that time wasted studying evidence law!

       The same kid, in 7th grade, received paper from the teacher at the beginning of the semester outlining the teacher's responsibilities and the student's responsibilities.Each student needed to sign to acknowledge that they read them. My stepson signed it, handed it to her, and said, "Minors can't be held to contracts."(When I studied for the bar, he read the contract law flash cards and found them entertaining.)2/

       Another detail worth noting: I liked her use of the word "unserious."She said something like, "In many ways Trump is an unserious person, but the consequequences of a second presidency would be devastating.""Unserious" succeeds the way understatements succeed. An accurate statement "buffoon" would sound like hyperbole LOL.

       So anyway, I had this idea that everyone, particularly young people, should learn what is taught in law school.I also had the idea that the way it is taught to young people is boring. It wasn't until law school that I realized how interesting this stuff is. The result ⤵️

       I just realized that it's April 23.  That means it's the anniversary of the Farmville, Virginia Motion High School student strike.  What? You don't know about that?   Well, in 1951, Barbara Johns was fed up with the deplorable conditions in her segregated school, so she organized a strike. She was inspired by labor strikes.After she and her classmates turned the rural town of Farmville upside down, she called in the NAACP.  1/
