Who taught you history? Slavery wasn't illegal until after the war was well underway. Also, on most issues the democrat and republican parties have switched sides since then, starting for example with racial equality. To be clear, no one was or did get kicked out through the entire process. The same people stayed and the side of more people having more freedom and being treated with more dignity won.
