In the unlikely event that the #FTC bans #noncompete clauses, the #infosec industry is going to go bonkers. This legal tactic is used constantly to scare people into not leaving to escape toxic work environments, find better pay or get better benefits (be it flexible hours, remote work, health care, retirement contributions, paid time off, etc.).I hope they decide to do it.https://www.wsj.com/articles/ftc-proposes-banning-noncompete-clauses-for-workers-11672900586

@adam Ignore non-competes. They are almost never enforceable. If your new employer wants you enough, they'll pay for the lawyers.

@adam my past employer sued my new employer to grt them to retract their job offer. They were in two very different business categories. Further, I never signed nor were they able to produce a non-compete clause but I couldn't afford a lawyer because I thrn had no job and had to move to another city.:guillotine:

@tprophet I know they're not enforceable for people who live in California, but even where it's :100: clear that they have no legal basis, many people are still unwilling to risk having to hire a lawyer let alone be taken to court.

@adam This shit would stop instantly if everyone is incredibly noisy about which companies threaten to enforce their non-competes. In an industry like #infosec where talent is scarce, employers are not the ones holding most of the cards here.

@adam I used it as a reason to not accept a job with Amazon. They compete with everybody. If you take the pay over 4 years and divide that over 6 years because of the non-compete, it's not a very good deal.

@Crazypedia Wow, that's extra sucky since you didn't even agree to the terms in the first place. Thanks for sharing. If you have any companies you're recommend not working for, I'd be happy to spread the words of warning.

@adam non-competes have been unenforceable in Ontario for a long while. But companies still put them into contracts, to intimidate the employees.Apparently they were finally banned altogether in October 2021. (of course, someone needs to complain for them to get caught)
