Hey Paulie,

OK, I would do this (avoid rm -r).

You should be able to change into that directory with cd \~ (when you are in 
it's parent).

ls -al (make sure its empty, and do what you need to do to make it empty.)

"cd" to the parent
rmdir \~ (if it fails it wont below up your home directory :)
