This is the most sickening part of this story and the general trend IMO. The
FBI et. al. regularly drops cases completely -- even when they are pedo/child
trafficking and so on -- to get tools they want and/or to keep a NDA with
company X that provides said software. Generally the NDA demands this such that
 the tool(s) cannot be exposed to the public (which they would if the case went
 through). It's become the status quo.

Now of course, the FBI and friends getting rootkits and the like is a bad
thing, but they do this on their own / large trades of this stuff and could do
it without what was described above.
