It seems that a lot of BBSes are hosted on VPSes provided by cloud providers. Surely these are susceptible to the same sort of hosting issues you mention above. Similarly, at least one of the more popular BBS packages is closed-source; users are at the whim of its author. Finally, even if one runs one's own servers, there are connectivity issues that must be dealt with. Pretty much all ISPs these days have an AUP.
