I don't know what you are thinking when the standard you mention is a culinary one. But I learned that the "is it a fruit, is it a vegetable" debate stems around which part of the MEAL the plant is used. If the plant is part of the main mean, then it is vegetable. If it is part of a dessert, then it is a fruit. Humans (or the culinarian variety) didn't like the idea of eating fruits as a main meal, so they simply referred to main- meal plants as veggies. The term vegetable is simply made up to delude oneself. But it still does not change the tomato's botanics as a fruit.
