They are getting due process...  The court they go through in an Immigration court and they see an Immigration Judge.

For example the "Maryland Dad" had not 1 but 2 days in court.  One where his case was presented to an Immigration Judge.  That judge made an order for deportation and this decision  was appealed and the appeals court said the order to deport was valid.  

As a side now, both judges said he was a gang member.

Some of the people getting deported in this mass deportation mess have been people who have committed crimes in the US... have been found guilty and have served time for crimes...

The later find out that no "Juan" is above the law.
