The fifth and fourteeth amendment extend due process and equal protection not just to "citizens" but to "persons", which the Supreme Court has consistenetly interpreted to include individuals regardless of their immigration status.

Illegal immigrants generally do not have the right to a government-paid lawyer in immigration court, and those stopped at the border may have fewer due process rights if they are considered to be seeking initial entry.
