If I am an American who goes into these countries to encourage people to head North (I am related to someone who, pre-COVID, did just this) knowing what can happen to them at the border, but I do it anyway, whose fault is that? IMHO, it is akin to claiming after the fact that the punishment for drunk driving is too harsh after one gets caught doing it and one knew the punishment beforehand.
