And only laws can have penalties for not obeying them. If Sleepy Joe writes an Executive Order that says "the people can't buy or sell flourescent bulbs", it's not illegal to ignore that and continue to buy and sell. There's no law. There's no penalty. Now, he can write an Executive Order to say that all gov't agencies must get rid of their flourescent bulbs. That would be legal. But that's the limit of an Executive Order. We went through all this mess in Michigan where our Tyrant er... "governor", thought that she could bypass the Legislature by using Executive Orders. The Sheriffs put an end to that idea quickly. And the courts have been ruling in favor of the people, and against the Tyrant's "novel ideas". One of the problems today is that the Elitists have pushed more and more authority into the Bureaucracy. (Remember the "We have to pass the bill to know what's in it."?) The Bureaucracy is part of the Executive Branch. That makes all that authority pushed there null and void since the Constitution makes it clear what branch can do what and there's nothing that says that the Legislature can cede power to a different branch.
