There is no felony because the law or crime that would bootstrap a felony has not been determined or has not been indicated by Bragg.

No it's not wrong. 
I do not know what your day to day is, meaning if you work all day and don't have the time to pay attention to something that has been known now for a quite a while or if you're within your golden years and your days are filled with relaxation after many years of working... 
In either case you should be aware of basic facts.
