From what Joe Biden said last week, it apparently was illegal as it took
action from his administration to allow it to happen.  Who it profits
depends on how you look at it.  If those laws are in place because many
countries where formula could be produced do not do so to proper standards
(not safe, mostly filler, etc.), then those who would profit from such
laws would be the public.

If they have regulations in place to make it difficult/impossible to
import/manufacture without their intervention, yes.
