For one: in the pre-RIR era, ARIN did not exist, so why should THEY have a claim on all the legacy adresses? RIPE, APNIC or LACNIC might claim them just as well.

The general consensus is that it is not worth the effort. It will take years if not decades of legal battle and in the end...
