You didn't actually answer the question... why is it OK now?

That is what they should be doing now.  If they have to round them all up and
send them somewhere "because they are all rapists and terrorists," send them to
GITMO to await trial.

You would still get the enjoyment of watching lefties throw fits, but
people like me would be satisfied that they are getting tried, that they
will be punished for their crimes, *and* can be deported, or sent back, if our
authorities f*cked up and arrested the wrong person.

Either way, the US is paying to have them held, so no one can point at it
with a straight face and claim any cost savings.
