You'd think so.  And I doubt eBay hosts their services where that kind of thing isn't illegal..  I briefly worked for eBay as a contractor, and I hadn't heard of it being hosted outside the US.  I know eBay is an American company, and I think that would also make them subject to US copyright laws.
