I continue to be confused about immigration issues. There is a student who moved here sometime in '96 with her parents who had "L" visas. On February 14, 1997 they filed for "Application to Extend/Change Nonimmigrant Status". In the body of the notice it reads "The above application for extension of stay is approved. The temporary stay of the named applicant(s) is authorized to the date shown above." That date was 2/15/97 to 2/15/99. She has produced an I-551 stamped with the date of June 19, 1998, valid until June 18, 1999. It shows an "Ent" date of 12/11/97. There seem to be several schools of thought regarding application dates and dates stamped on I-551's. My inclination is to accept the "Ent" date of 12/11/97 on the I-551 because it would appear to be the date that her actual status changed from L2 and made her a permanent resident. I know others accept the date of the application as proof of intent to establish permanent domicile. However, I believe the very nature of this student's visa (L2) precluded her from being eligible for Washington state resident status until her immigration status had actually changed. I'm trying to be consistent in these determinations, and I would prefer to grant resident status to the student sooner than later, but I also want to be able to pass an audit. Thanks.
