Hi,

I have a question regarding legal = guardian.

The situation is:  Student = is 20 and living with grandparents.  One parent lives in WA , the = other parent lives out of state.  The grandparents raised and = claimed  him on their taxes from ages 13 – 18, and then again = at age 20.  Student left the state to stay with dad for a year = (went to school for awhile, then worked).  He returned to WA to = live with grandparents and attend college.  Grandparents did not = claim him for 2002, but will claim him for 2003. 

Question:  Since he is = financially dependent upon his grandparents, can they complete the = residency questionnaire as legal guardian since they have been claiming = him on taxes?

I'm thinking since he is not = financially dependent upon his parents, he technically does not have = dual residency so he gave up residency when he moved away, = right?
