The burden of proof of declaration of intent to become a resident is on her, not you. As you say, you can offer advice when you are asked the question, but you can't assume than any student--even one who was formerly a resident--wants to become a resident. Joe St.Hilaire Western ---------- From: RESIDENCY-owner To: Discussion of Residency Issues State Wide Subject: Residency Denial Date: Tuesday, September 17, 1996 11:01AM I am taking a lot of heat for a recent residency denial. The student has papered the administration with letters about my decision. The AG is involved as well, but with school starting soon, the suggestion was made that I send you all the scenario to see if you have any suggestions or if you would have done anything differently. Here it goes... >From 1989 to 1993 this student resided in Washington and was a student at Evergreen paying resident tuition. She left the state for Wisconsin as of Summer 1993, changing her driver's license to Wisconsin as of July 23, 1993. She stored her car and goods with family in Bremerton while in Wisconsin. She returned to Washington as of August, 1995 and began full-time student status as of September 25, 1995. She did not change her driver's license back to Washington until February 10, 1996. The late change of driver's license is my basis for denial. She claims that she was never told what to do and that it's our institutional error. Was I right to deny her on this basis? As well, what do all of you do with regards to "advising" students how to become residents. I feel very uncCmfortable with this term. It's my opinion that if students are here to make Washington their home they will change the documentation that is required once they arrive. It is not my place to assume that every non-resident student is here to establish a domicile. Certainly, I'm available to answer all questions and have an information sheet available. Is there more that others do in this regard. I appreciate your help and suggestions... Andrea Coker-Anderson - The Evergreen State College .
