It's on a CD and should be free from an Apple dealer. I had dumped OS 10 for the same reason, but came back after trying out the upgrade. Remaining problems with OS 10 are principally printer, scanner, and USB device drivers which haven't come out yet. Another upgrade, 10.2, is due, perhaps in January, more likely in March.
