The "presumption" clause for overcoming the assumption the person is not in the state solely for the purpose of attending school get confusing for me. And then when I add dependency issues...! Person #1 is dependent on her parents who live in Nigeria. Mother has US citizenship as does this student. Student has been living in WA since August of 1997 and can show proof of living arrangements. The student immediately obtained a WA ID card (8/97) and later a driver's licence (10/98) and opened bank accounts (8/97). The student does not own a vehicle, has worked only a few weeks since living in the state. The student registered for school fall 97, winter, spring fall of '98 but didn't (in all quarters) complete the term. Has the person overcome the presumption with the living arrangement, bank accounts and driver's license? Person #2 can show bank statements (Nov. 97), living arrangements (beginning Nov. 27) and a 1997 W-2 form (did not earn enough to file taxes). But the person didn't get a WA state driver's license until October of 98. The person is requesting residency as an independent. Parents who are out of state did not claim the student on 97 taxes or plan to for 98. However, the student does not yet have 98 W-2s to show or can't prove how much income has been earned this year (but isn't sure it was $6000.) What's your take? .
