He came to Washington State (where his fiance lives) and obtained a WDL (12/97) and registered to vote (1/98). He also filed a "State of Legal Residence Certificate" (DD Form 2058)listing Washington with the military for purposes of withholding State income taxes in 1/98. He does not own a motor vehicle. He then returned to finish his military service in Hawaii. He was discharged in 5/98. He had his belongings shipped to Washington (I have documentation) but went to Tennesee immediately upon discharge to visit his parents. (He says by going immediately to Tennessee, he got an airline ticket.) After his visit, he returned to Washington (and his fiance) and has been here since then. Did the student establish an intent to remain in WA in 12/97? Or is continuous physical presence required? -- Janelle Miner, Registrar Whatcom Community College jminer@whatcom.ctc.edu or (360)676-2170 .
