Renzo Tosi in his _Dizionario delle sentenze latine e greche_
(Rizzoli, ISBN 88-17-14516-5) traces the maxim back to Clytemnestra's
words in Euripides's _Iphigenia at Aulis_ (l. 1142):

        auto de to sigan omologountos esti sou

with a parallel in Sophocles's _Trachiniae_ (l. 813 fol.).

In Latin, Tosi quotes Seneca the Elder (_Controversiae_, 10,2,6):

        silentium videtur confessio

and adds references to:
