The following is a first draft of the release form. I have tried to be sensitive to the general concerns expressed at our last meeting. One last thought: would "consideration" be more lawyerly than "exchange" in the opening line? ---- LaPlaza TeleCommunity Foundation Release Form and Agreement In exchange for the use of the LaPlaza Community Computer Network ("Network"), I understand and agree to the following: 1) The use of the Network is a privilege. The responsiblilities that come with this privilege are to be civil, courteous, polite and lawful. The Network subscribes to the principles stated in the First Amendment to the Constitution of the United States. The Network reserves the right to suspend or revoke such privileges at any time for conduct that does not [comply with / adhere to] these standards and those of the Taos community. The administration of the Network will be the sole arbiter. 2) The Network reserves the right to review any material stored in files to which all users have access, and will edit or remove any material which the Network administration, in its sole discretion, believes to be unlawful or otherwise unacceptable. 3) All information services and features contained on the Network are intended for the private use of its patrons except where authorized by the Network for other purposes. 4) All information contained on the Network is placed there for general informational, educational and entertainment purposes and is, in no way, intended to refer to, or be applicable to, any person, case, or situation. 5) The Network does not warrant that the functions of the system will meet any user's specific requirements, or that it will be error-free or uninterrupted; nor shall the Network be liable for any direct or indirect, incidental, or consequential damages (including lost data, information, or profits) sustained or incurred in connection with the use, operations, or inability to use the system. Privacy will be respected but cannot be guaranteed. 6) Users are to abide by the rules and regulations of system usage as may be promulgated by the administration of the Network. 7) In consideration for the privilege of using the Network and for having access to the information contained on the Network, I hereby release and hold harmless the Network, its operators, and any institutions with which they are affiliated from any and all claims of any nature arising from my use, or inability to use, the Network. .
