     Lee Tisdel, relator, is seeking a writ of mandamus to compel
respondent, the Court of Common Pleas, to issue findings of  fact
and conclusions  of law in C.P.  Case No. CR-337124.   Respondent
moved for  summary  judgment and  attached  a certified  copy  of
Findings of Fact and Conclusions of Law signed by Judge Fuerst and
filed March 11, 1999, in C.P. Case No. CR-337124.  Relator's action
is now moot. Respondent's motion for summary judgment is granted.
Costs to relator.
