PATRICIA A. BLACKMON, A.J.:
     On September 21, 1998,  the relator, Eric Miller,  commenced
this  mandamus action  to compel  the respondent  judge to  issue

findings of fact and conclusions of law for a postconviction relief
petition, which  Mr. Miller  on  January 9,  1998, filed  in  the
underlying case, State  of Ohio v.  Eric Miller, Cuyahoga  County
Common Pleas Court Case No. CR-245076.  However, a review of  the
underlying case reveals that the respondent fulfilled his duty by
issuing the required findings of fact and conclusions of law on May
11, 1998,  a copy of which  is attached and incorporated  herein.
Accordingly, this  mandamus action is  moot, and  this court  sua
sponte dismisses this action.  Costs assessed against relator.
