     Harold Price, relator,  is seeking a  writ of procedendo  to
compel respondent, Judge Richard McMonagle, to rule on his Motion
for Jail Time Credit filed February 3, 1998 in C.P. Case No.  CR-
335869.   Respondent moved for  summary judgment  and attached  a
certified copy of a journal entry filed May 19, 1998, in C.P. Case
No. CR-335869 wherein respondent denied relator's Motion for Jail
Time  Credit prior  to  the commencement  of  this action.    The
requested relief  having  been performed,  this action  is  moot.
Accordingly, respondent's motion for summary judgment is granted.
     Case dismissed.  Costs to relator.
