PATRICIA A. BLACKMON,A.J.:
     Timothy Nash, relator,  is seeking a  writ of procedendo  to
compel respondent, Judge Jose A. Villanueva, to rule on his Motion
for Resentencing Under Senate Bill 2 filed in C.P. Case Nos.  CR-
341137/341265  on May  21, 1998.   Respondent  moved for  summary
judgment and attached a  certified copy of a journal entry  filed
September 10,  1998,  in  C.P. Case  Nos.  341137/341265  wherein
respondent denied relator's May 21, 1998 motion to be resentenced
under Senate Bill 2.  Respondent has demonstrated that this action
is now moot. Accordingly, respondent's motion for summary judgment
is granted.
     Case dismissed.  Costs to respondent.
