COURT OF APPEALS OF OHIO, EIGHTH DISTRICT COUNTY OF CUYAHOGA NO. 74823 STATE OF OHIO, EX REL. : PETITION FOR WRIT OF LAWRENCE WALKER : MANDAMUS : Relator : MOTION NO. 97713 : vs. : JOURNAL ENTRY AND OPINION : COURT OF COMMON PLEAS : (JUDGE RONALD SUSTER) : CUYAHOGA COUNTY, OHIO : : Respondent : : DATE OF ANNOUNCEMENT OF DECISION : AUGUST 27, 1998 JUDGMENT : WRIT DISMISSED. DATE OF JOURNALIZATION : APPEARANCES: For Relator : LAWRENCE WALKER, Pro Se No. 355-199 Belmont Correctional Institute P. O. Box 540 St. Clairsville, Ohio 43950 For Respondent : STEPHANIE TUBBS-JONES Cuyahoga County Prosecutor ERIKA RITT, Assistant Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 -2- PATRICIA A. BLACKMON, A.J.: On July 6, 1998, the relator, Lawrence Walker, commenced this mandamus action against the respondent, the Cuyahoga County Common Pleas Court, to compel the court to grant him the proper jail time credit in the underlying cases, State v. Walker, Cuyahoga County Common Pleas Court Case Nos. CR-351287 and CR-353793. He maintains that he is entitled to twenty days of credit, but that he only received credit for seven days. The dockets for the two underlying cases reveal that on March 30, 1998, he moved the respondent to correct and/or clarify jail time credit. On July 20, 1998, the respondent moved for summary judgment on the grounds of mootness. Attached to the dispositive motion were copies of certified journal entries in the underlying cases, granting Mr. Walker thirteen days credit in Case No. CR-351287 and sixteen days credit in Case No. CR-353793. These journal entries establish that the respondent has fulfilled its duties, to rule on the outstanding motions and to state explicitly in a journal entry the number of days jail credit to which Mr. Walker is entitled. State ex rel. Corder v. Wilson (1991), 68 Ohio App.3d 567, 589 N.E.2d 113. Accordingly, this mandamus action is moot. The court grants the respondent's motion for summary judgment and dismisses this case. Costs assessed against relator. JAMES M. PORTER, J., CONCURS. -3- .
