PATRICIA A. BLACKMON,A.J.:
     Albert Bradley, relator, is seeking a writ of procedendo  to
compel respondent, Judge Peggy Foley-Jones, to rule on a Motion to
Withdraw Guilty Plea filed  in Cuyahoga County C.P. Case No.  CR-
341466.  Counsel  for respondent moved  for summary judgment  and
attached a certified copy of a journal entry that demonstrates that
respondent denied relator's motion on December 18, 1997, six months
prior to  the commencement  of this action.   Neither  a writ  of
mandamus nor a writ of procedendo will be issued to compel an act
that has already been performed.  See State ex rel. Jerningham v.
Cuyahoga County Court of Common Pleas (1996), 74 Ohio St.3d  278,
658 N.E.2D 723; State ex rel. Person v. Sweeney (Oct. 13,  1994),
Cuyahoga App. No.  67960, unreported; State  ex rel. Manigold  v.
Gaughan (Dec. 3, 1993), Cuyahoga App. No. 66484, unreported.
     Accordingly, respondent's  motion  for summary  judgment  is
granted.  Costs to relator.
