COURT OF APPEALS OF OHIO, EIGHTH DISTRICT COUNTY OF CUYAHOGA NO. 74728 STATE OF OHIO, EX REL. : PETITION FOR WRIT OF JERRY MOORE : MANDAMUS : Relator : MOTION NO. 98771 : vs. : JOURNAL ENTRY AND OPINION : KATHLEEN S. CRAIG, JUDGE : COURT OF COMMON PLEAS : CUYAHOGA COUNTY, OHIO : and : STEPHANIE TUBBS JONES : CUYAHOGA COUNTY PROSECUTOR : : Respondent : : DATE OF JOURNALIZATION : OCTOBER 8, 1998 JUDGMENT : WRIT DENIED. APPEARANCES: For Relator : JERRY MOORE, Pro Se No. 207-625, Dorm A-30 P. O. Box 4571 Lima, Ohio 45802 For Respondent : STEPHANIE TUBBS-JONES Cuyahoga County Prosecutor RANDI MARIE OSTRY, Assistant Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 -2- PATRICIA A. BLACKMON, A.J.: Relator requests, inter alia, that this court compel respondent judge to issue findings of fact and conclusions of law with respect to the petition for postconviction relief filed by relator in State v. Moore, Cuyahoga County Court of Common Pleas Case No. CR-227207 on July 28, 1998. Respondents--judge and prosecuting attorney--have jointly filed a motion for summary judgment (Motion No. 97212) attached to which is a copy of the findings of fact and conclusions of law issued by respondent judge and received for filing by the clerk on July 28, 1998. Respondents argue that this action in mandamus is, therefore, moot. We agree. Additionally, relator has not demonstrated that he has a clear legal right to any of the other relief which he seeks. Furthermore, relator failed to comply with Loc. App. R. 8(B)(1) which requires that complaints in original actions be supported by an affidavit from the plaintiff or relator specifying the details of the claim. Accordingly, respondents' motion for summary judgment is granted. Relator to pay costs. Writ denied. JAMES M. PORTER, J., CONCURS. PATRICIA A. BLACKMON, .
