Edwards, has filed a complaint for a writ of mandamus and seeks an order from this court that requires the respondents, Wesley A. Dumas, Esq. and Ronald Turner, to deliver copies of all investigative notes and files that relate to the criminal matter of State v. Edwards, Cuyahoga County Court of Common Pleas Case No. CR-330064. Apparently, respondent Wesley A. Dumas represented the relator during the course of the criminal matter while respondent Ronald Turner was appointed by the trial court to act as an investigator. For the following reasons, we dismiss the relator's complaint for a writ of mandamus. Attached to respondent Wesley A. Dumas' motion to dismiss is a copy of an affidavit that clearly provides that all requested information has been provided to the relator. See, also, Motion to Dismiss as filed by respondent Ronald K. Turner. Mandamus will not issue to compel a vain act. State ex rel. Strothers v. Turner (1997), 79 Ohio St.3d 272; State ex rel. Leach v. Schotten (1995), 73 Ohio St.3d 538. In addition, mandamus will not lie to enforce a private right against a private person. State ex rel. Longacre v. Penton Publishing Co. (1997), 77 Ohio St.3d 266; State ex rel. Russell v. Duncan (1992), 64 Ohio St.3d 538; State ex rel. Pressley v. Indus. Comm. (1967), 11 Ohio St.2d 141. Accordingly, the motions to dismiss are granted. Costs to relator. Writ dismissed. -3- JAMES M.
