COURT OF APPEALS OF OHIO, EIGHTH DISTRICT COUNTY OF CUYAHOGA NO. 74404 STATE OF OHIO, EX REL. : PETITION FOR WRIT OF JIMMIE L. GRANT : MANDAMUS : Relator : MOTION NO. 95826 : vs. : JOURNAL ENTRY AND OPINION : COURT OF COMMON PLEAS : CUYAHOGA COUNTY, OHIO : : Respondent : : DATE OF ANNOUNCEMENT OF DECISION : JULY 2, 1998 JUDGMENT : WRIT DENIED. DATE OF JOURNALIZATION : APPEARANCES: For Relator : JIMMIE L. GRANT, Pro Se No. R146-933 North Central Corr. Inst. P. O. Box 1812 Marion, Ohio 43301-1812 For Respondent : STEPHANIE TUBBS-JONES Cuyahoga County Prosecutor DANIEL MARGOLIS, Assistant Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 PATRICIA A. BLACKMON, A.J.: Relator avers that he is the defendant in State v. Grant, Cuyahoga County Court of Common Pleas Case No. CR-171404. On -2- December 11, 1997, relator filed what he captioned as motion for de novo determination or nunc pro tunc order, correcting the sentencing entry ( motion to correct sentence ) in Case No. CR- 171404. Relator requests that this court compel respondent to issue a journal entry disposing of the motion. Respondent has filed a motion for summary judgment (Motion No. 95004). Attached to Motion No. 95004 is a copy of the docket in Case No. CR-171404 which reflects that the motion to correct sentence was denied by entry received for filing on March 16, 1998. In response, relator indicates that he has not received the entry denying the motion to correct sentence and requests that this court compel respondent to send a copy of the entry to relator. Relator does not, however, set forth any authority establishing that respondent has a clear legal duty to send relator the entry. In State ex rel. Lockhart v. Coyne (June 11, 1998), Cuyahoga App. No. 73240, unreported, the relator requested that this court compel the respondent judge to rule on a motion to correct sentence. We held that the relator's request for relief in mandamus was moot. This action requires the same result. Accordingly, in light of Lockhart, we grant respondent's motion for summary judgment. Relator to pay costs. Writ denied. JAMES M. PORTER, J., CONCURS. PATRICIA A. BLACKMON, .
