     Devin Chaney, relator, is seeking a writ of mandamus to compel
respondent, Judge William Mahon,  to rule on his motion for  jail
time filed November 21, 1997, in Cuyahoga County Court of  Common
Pleas Case No CR-336617 or to order one hundred thirty-seven days
credited to  his  sentence.   The  prosecutor moved  for  summary
judgment and attached as Exhibit A a certified copy of a  journal
entry signed by Judge Carl Character (Judge Mahon retired) granting
relator's motion for jail time credit in C.P. Case No. CR-336617 on
January 8, 1997.  This action is moot since the relief  requested
has been performed.
     Case dismissed.  Costs to relator.
