PATRICIA A. BLACKMON,A.J.:
     Michael D. Ketterman, relator, is seeking a writ of mandamus
to compel respondent, the  Cleveland Municipal Court, to  dismiss
Case No. 96TRD012890 against him in the Cleveland Municipal Court
since over one hundred eighty days have elapsed without a  trial.
Respondent filed a motion to dismiss the petition, which we grant
for the following reason.
     Attached to respondent's  motion is a certified copy of  the
docket in Cleveland Municipal  Court Case No. 96TRD012890,  which
shows that on October 24, 1997, prior to the commencement of this
writ  action, the  case was  dismissed for  want of  prosecution.
Relator's  request is thus  moot.  State,  ex rel. Jerningham  v.
Cuyahoga County Court of Common Pleas (1996), 74 Ohio St.3d  278,
658 N.E.2d 723.
     Accordingly, case is dismissed.  Costs to relator.
