On January 9, 1998, the relator, Tyrone Hereford, commenced this mandamus action against the respondent, Judge Jose Villanueva, to compel the judge to issue findings of fact and conclusions of law for postconviction relief petitions, which Mr. Hereford filed in the underlying case, State of Ohio v. Tyrone Hereford, Cuyahoga County Common Pleas Court Case Nos. CR-275830 and 275789. On February 10, 1998, the respondent, through the Cuyahoga County Prosecutor, moved for summary judgment on the grounds of mootness. Mr. Herford never filed a response. Attached to the dispositive motion was a copy of a certified, signed and file-stamped journal entry containing the requisite findings of fact and conclusions of law for Mr. Hereford's petitions. This attachment establishes that the judge has fulfilled his duty to issue the findings of fact and conclusions of law and that Mr. Hereford has received his requested relief, a resolution of his postconviction petitions. Additionally, Mr. Hereford failed to support his complaint for mandamus with an affidavit specifying the details of the claims as required by Local Rule 8(B)(1). Accordingly, the motion for summary judgment is granted, and this writ action is dismissed. Costs assessed against relator. JAMES M. PORTER, J., CONCURS. ___________________________________ .
