COURT OF APPEALS OF OHIO, EIGHTH DISTRICT COUNTY OF CUYAHOGA NO. 73712 STATE OF OHIO, ex rel. : WALTER COCKRELL : : PETITION FOR WRIT OF Relator : MANDAMUS : vs. : MOTION NO. 92044 : NANCY RUSSO, JUDGE : JOURNAL ENTRY AND OPINION COURT OF COMMON PLEAS : CUYAHOGA COUNTY, OHIO : : Respondent : DATE OF ANNOUNCEMENT OF DECISION : MARCH 5, 1998 JUDGMENT : WRIT DISMISSED. DATE OF JOURNALIZATION : APPEARANCES: For relator : WALTER COCKRELL, pro se #341-724 Post Office Box 69 London, Ohio 43140-0069 For respondent : STEPHANIE TUBBS-JONES Cuyahoga County Prosecutor LISA REITZ WILLIAMSON, Assistant Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 -2- PATRICIA A. BLACKMON,A.J.: Walter Cockrell, relator, is seeking a writ of mandamus to compel respondent, Judge Nancy Russo, to designate additional jail time credit for time spent in community-based correctional facilities and programs. Respondent has filed a motion for summary judgment, which this court grants for the following reason. Attached as Exhibit "A" to respondent's motion for summary judgment are journal entries that demonstrate that respondent denied relator's motions for additional jail credit on September 15, 1997, in C.P. Case Nos. CR-337335 and CR-340648. This action is moot since respondent had already fulfilled her obligation to rule on relator's motions prior to the commencement of this action on December 19, 1997. A writ will not issue to compel an act already performed. State ex rel., Jerningham v. Cuyahoga County Court of Common Pleas (1996), 74 Ohio St.3d 278, 658 N.E.2d 723. The proper remedy for challenging the calculation or denial of requested jail time credit is through direct appeal. See State ex rel. Wilmore v. Pokorny (Oct. 30, 1997), Cuyahoga App. No. 73098, unreported; State ex rel. Johnson v. O'Donnell (Oct. 4, 1994), Cuyahoga App. No. 67783, unreported; State ex rel. Corder v. Wilson (1991), 68 Ohio App.3d 567, 589 N.E.2d 113. Accordingly, judgment for respondent. Costs to relator. -3- JAMES M. PORTER, J., CONCURS .
