PATRICIA A. BLACKMON,A.J.:
     Gregory Houston, relator,  is seeking a writ of mandamus  to
compel respondent, Judge Peggy Foley Jones, to issue findings  of
fact and conclusions of law for his postconviction petition filed
in February,  1997, and  to issue jail  time credit  in State  v.
Houston, Common Pleas  Case No. CR-315331.  Respondent moved  for
summary judgment  and,  for the  reasons  that follow,  we  grant
respondent's motion.
     As evidenced by  Exhibits A and  B attached to  respondent's
motion,  respondent  issued the  subject  findings  of  fact  and
conclusions of law on  January 15, 1998, and granted relator  one
hundred seven (107) days of jail time credit on January 14, 1998.
Respondent fulfilled her duties, thus rendering this action moot.
State ex rel. Jerningham v. Cuyahoga County Court of Common Pleas
(1996), 74 Ohio St.3d 278, 658 N.E.2d 723.
     Accordingly, case is dismissed.  Costs to respondent.
