however, on January 13, 1998, a  Notice of Voluntary Dismissal  was
filed stating:
      Pursuant to Ohio App. R. 28, we the attorneys for the
     respective parties shown below hereby stipulate that
     the above-captioned Appeal should be dismissed with
     prejudice at Appellees' costs.
     Accordingly, pursuant to App. R. 28, this case is hereby
dismissed with prejudice at appellees' costs.
