COURT OF APPEALS OF OHIO, EIGHTH DISTRICT COUNTY OF CUYAHOGA NO. 73112 STATE OF OHIO, ex rel. : KENNETH LAWRENCE : : PETITION FOR WRIT OF Relator : HABEAS CORPUS : vs. : MOTION NO. 86898 : GERALD T. McFAUL, SHERIFF : JOURNAL ENTRY AND OPINION : Respondent : DATE OF ANNOUNCEMENT OF DECISION : SEPTEMBER 25, 1997 JUDGMENT : WRIT DISMISSED. DATE OF JOURNALIZATION : APPEARANCES: For relator : KENNETH LAWRENCE, pro se Post Office Box 5600 Cleveland, Ohio 44101 For respondent : STEPHANIE TUBBS-JONES Cuyahoga County Prosecutor Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 2 JAMES D. SWEENEY, C.J.: Sua sponte, Complaint in Habeas Corpus is dismissed for several reasons. Relator entitled his action "State of Ohio v. Kenneth Lawrence," thereby failing to name a respondent. (The name "Gerald T. McFaul" was gratuitously added by the clerk of court and could be incorrect since relator states he is incarcerated at the Lorain Correctional Institution.) Relator also has failed to support his petition with a copy of the order of his commitment as required by R.C. 2725.04(D), thereby warranting dismissal. Bloss v. Rogers (1992), 65 Ohio St.3d 145, 602 N.E.2d 602; State ex rel. Wynn v. McFaul (Aug. 28, 1997), Cuyahoga App. No. 72993, unreported. Relator also has not challenged the lawfulness of his imprisonment, R.C. 2725.01, but states only that he will be deprived of due process if he remains incarcerated during his appeal and his term of imprisonment expires before his appeal is heard. Finally, if relator is incarcerated at the Lorain Correctional Institution in Lorain County, this action cannot be maintained in this court in Cuyahoga County. R.C. 2725.03; Bridges v. McMackin (1989), 44 Ohio St.3d 135, 541 N.E.2d 1035; State ex rel. Washington v. Anderson (Apr. 2, 1996), Cuyahoga App. No. 70368, unreported. Case dismissed. Costs to relator. 3 PATRICIA A.
