COURT OF APPEALS OF OHIO, EIGHTH DISTRICT COUNTY OF CUYAHOGA NO. 72738 STATE OF OHIO, ex rel. : ABDUL SHARIF : : PETITION FOR WRIT OF Relator : MANDAMUS : vs. : MOTION NO. 85783 : NANCY R. McDONNELL, JUDGE : JOURNAL ENTRY AND OPINION COURT OF COMMON PLEAS : CUYAHOGA COUNTY, OHIO : : Respondent : DATE OF ANNOUNCEMENT OF DECISION : AUGUST 14, 1997 JUDGMENT : WRIT DISMISSED. DATE OF JOURNALIZATION : APPEARANCES: For relator : ABDUL SHARIF, pro se #212-173 Post Office Box 1812 Marion, Ohio 43301 For respondent : STEPHANIE TUBBS-JONES Cuyahoga County Prosecutor RANDI MARIE OSTRY, Assistant Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 -2- JAMES D. SWEENEY, C.J.: Relator, Abdul Sharif, seeks a writ of mandamus in order to verify the grand jury minutes and approve the indictment in the underlying case of State v. Sharif, Cuyahoga Common Pleas Case No. CR-238403. The respondent, Stephanie Tubbs-Jones, has filed a motion to dismiss the relator's petition for a writ of mandamus. The relator's petition for a writ of mandamus is duplicative of the petition for a writ of mandamus as previously filed in State ex rel. Sharif v. Cuyahoga County Prosecutor (Mar. 6, 1997), Cuyahoga App. No. 71836, unreported. The identical issues of verification of grand jury minutes and approval of the indictment were previously raised and found to be without merit. The doctrine of res judicata prevents further examination of these issues. See, generally, State v. Perry (1967), 10 Ohio St.2d 175. Accordingly, we grant the respondent's motion to dismiss. Costs to relator. Writ dismissed. .
