Assistant County Prosecutor Justice Center - 8th Floor 1200 Ontario Street Cleveland, OH 44113: SWEENEY, C.J.: 2 On June 16, 1997, the relator, Eugene Black, commenced this mandamus action against the respondents, judges of the Cuyahoga County Common Pleas Court, to compel them to grant him credit for jail time served in the two underlying cases, State of Ohio v. Eugene Black, Cuyahoga County Common Pleas Court Case Nos. Cr. 181032 and Cr. 329210. Mr. Black had moved for jail time credit in May 1996. On July 25, 1997, the respondents, through the Cuyahoga County Prosecutor, moved for summary judgment on the grounds of mootness. Attached to the motion were certified copies of file-stamped journal entries in the two underlying cases in which the judges granted Mr. Black credit for jail time served. The court granted Mr. Black 269 days in Case No. Cr. 181032 and 113 days in Case No. Cr. 329210. These journal entries establish that Mr. Black has received the requested relief. Thus, the mandamus action is moot. The motion for summary judgment is granted, and this writ action is dismissed. Respondent to pay costs. .
