COURT OF APPEALS OF OHIO, EIGHTH DISTRICT COUNTY OF CUYAHOGA NO. 72653 STATE OF OHIO, ex rel. : WILLIE J. WILLIAMS : : PETITION FOR WRIT OF Relator : MANDAMUS : vs. : MOTION NO. 86296 : KATHLEEN ANN SUTULA, JUDGE : JOURNAL ENTRY AND OPINION COURT OF COMMON PLEAS : CUYAHOGA COUNTY, OHIO : : Respondent : DATE OF ANNOUNCEMENT OF DECISION : AUGUST 28, 1997 JUDGMENT : WRIT DENIED. DATE OF JOURNALIZATION : APPEARANCES: For relator : WILLIE J. WILLIAMS, pro se #324-679 Belmont Correctional Institution Post Office Box 540 St. Clairsville, Ohio 43950 For respondent : STEPHANIE TUBBS-JONES Cuyahoga County Prosecutor JOHN R. MITCHELL, Assistant Justice Center, Courts Tower 1200 Ontario Street Cleveland, Ohio 44113 2 JAMES D. SWEENEY, C.J.: Relator, Willie J. Williams, seeks a writ of mandamus in order to compel the respondent, Judge Kathleen Ann Sutula, to grant a "motion to vacate and modify sentences to conform with the laws of amended Senate Bill #2 Civil Division" as filed in the underlying case of State v. Williams, Cuyahoga County Court of Common Pleas Case No. CR-334365. The respondent has filed a motion for summary judgment. A review of the docket in CR-334365 demonstrates that the respondent denied the relator's motion to vacate and modify sentence and also filed findings of fact and conclusions of law on June 24, 1997. The relator possesses an adequate remedy at law through a direct appeal. State ex rel. Woodbury v. Spitler (1973), 34 Ohio St.2d 134. Thus, mandamus is not appropriate. See, also, State ex rel. Lemmon v. Ohio Adult Parole Authority (1997), 78 Ohio St.3d 186. Accordingly, we grant the respondent's motion for summary judgment. Costs to relator. Writ denied. .
